Agreeing to these terms

These Terms of Service ("Terms") are an agreement between you and Loot Financial Services Corp ("Loot", "we", "us"). By using blackbeard.ai or joining the Blackbeard waitlist, you agree to these Terms, our Privacy Policy and our SMS Terms. If you don't agree, please don't use the site or join the waitlist.

Who can join

• You must be at least 18 years old.
• You must be in the United States and joining on behalf of yourself or a business you own or are authorized to represent.
• You must use a mobile number that you own or are authorized to use, and keep it accurate.

How the waitlist works

• Joining is free. It doesn't create an account or give you access to the Blackbeard service.
• We don't promise that you'll get access, or when. We invite people in the order and at the pace we choose.
• We may change, pause or end the waitlist at any time, and we may remove sign-ups that look fraudulent, automated or that break these Terms.
• When your spot opens, using Blackbeard will be subject to additional terms, which you'll be asked to accept before you use it.

Not an offer of credit or financial advice

Descriptions of Blackbeard on this site, including paying bills, moving money and the Loot line, are previews of planned features. They are not an offer or commitment to extend credit. Any Loot line is subject to a separate application, approval and agreement. Nothing on this site is financial, tax, legal or accounting advice.

By entering your number and tapping "Send code", you agree to receive texts from Blackbeard as described in our SMS Terms. Reply STOP to opt out at any time.

Using the site

Please don't misuse the site. That includes signing up other people's numbers, using bots or scripts to join the waitlist, trying to break or overload the site, or copying it for a competing product.

Our content

The site, the Blackbeard name, character, artwork and logos, and the Loot name and logos belong to Loot or its licensors. You may view the site for your own use, but you may not copy, modify or reuse them without our written permission.

No warranties

The site and waitlist are provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee the site will be uninterrupted or error-free, or that texts will always be delivered.

Limitation of liability

To the fullest extent allowed by law, Loot won't be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data, arising from your use of the site or the waitlist. Our total liability for any claim related to the site or waitlist is limited to $100.

Governing law

These Terms are governed by the laws of the State of [Governing state], without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in [Governing state], and you and Loot consent to their jurisdiction.

Changes to these terms

We may update these Terms from time to time. We'll post the new version here and change the "Last updated" date. If you keep using the site or stay on the waitlist after a change, you accept the updated Terms.
